National General Secretary PK Kunhalikutty said that the Waqf Amendment Act is against the Constitution

Kozhikode: PK Kunhalikutty, national general secretary of the Indian Union Muslim League (IUML), said on Tuesday that the Waqf Amendment Act violates the Constitution.

“We are confident,” PK Kunhalikutty, National General Secretary of the Indian Union Muslim League (IUML), told ANI. The case is being heard by the Supreme Court. Senior Advocate Kapil Sibal is here, and we have submitted our petition. The Constitution forbids the Waqf Amendment Act. That’s what we think.

Senior counsel Kapil Sibal is defending their appeal, he said, and the case is now before the Supreme Court. On April 7, the Supreme Court discussed the petitions that were brought against the Waqf (Amendment) Act, 2025.

Kunhalikutty discussed the circumstances in Munambam, saying, “Munambam is a distinct problem… Here, it may be resolved by agreement between the parties. For that, the Keralan government took some action. Nothing about the Waqf Bill is relevant.

In the Ernakulam district’s seaside hamlet of Munambam, some 610 households have been opposing the Waqf Board’s claim to their property.

Parliament enacted the Waqf (Amendment) Bill, 2025, during the budget session, and President Droupadi Murmu signed it into law on April 5.

After a protracted discussion, the Lok Sabha approved the law with 288 members voting in favor and 232 against it, while the Rajya Sabha passed it on April 4 with 128 votes in favor and 95 against.

The Waqf (Amendment) Bill, 2025, aims to improve waqf property development, empower pertinent players to do so, and increase the effectiveness of the registration, survey, and case disposition procedures. Although managing waqf holdings is still the primary goal, contemporary, scientific approaches are being used to improve governance. Additionally, the Mussalman Wakf Act of 1923 was revoked.
