US News : USCIS extends renewal period for immigrants’ EAD, who will benefit and what is EAD?
US News : Earlier this year, U.S. Citizenship and Immigration Services (USCIS) passed a temporary final rule that increased the 180-day maximum automatic renewal duration for certain employment authorization cards (EADs) to 540 days.
“The Department of Homeland Security (DHS) proposes to amend its regulations governing certain nonimmigrant workers,” according to the new regulation notice, “Modifying Accreditation Regulations Governing Nonimmigrant Workers [1615-AC88].”
The proposed changes include modernizing policies and procedures for Employment Authorization Documents, updating the rules regarding dependent spouses of certain nonimmigrants, and providing more flexibility to certain nonimmigrant workers, such as those who resign or are fired from their jobs and religious workers who have reached their maximum stay or are awaiting the issuance of immigrant visas.
Why The Outcome Of The EAD Regulatory Case Matters
This rule’s objective is to prevent noncitizens with legitimate work authorization from losing their job eligibility while their applications for EAD renewals are being handled. This follows a year of significant progress in cutting EAD processing times.
This proposal is a continuation of a USCIS program to lower obstacles to work authorization in order to facilitate the hiring of noncitizens.
Verify Eligibility And Other Information
With some amendments valid until January 2025, the regulation, which went into effect on April 8, 2024, will remain in existence until September 20, 2027.
As long as their application is still pending by April 8, 2024, this change will affect eligible noncitizens who filed an application for EAD renewal on or after October 27, 2023. This extension will also apply to anybody who files Form I-765, the application for EAD renewal, during the 540 days that begin on April 8, 2024.
