Court denies bail to former principal of RG Kar, says he may be sentenced to death if serious charges are proved
Kolkata Rape Murder Case: Sandip Ghosh, the former principal of RG Kar Medical College and Hospital, was denied bail by a designated CBI court, noting that the charges against him are serious and carry the possibility of death penalty if proven.
Ghosh and Abhijit Mondal, the previous official in charge of Tala police station, were detained by the CBI on August 9 for allegedly tampering with evidence and delaying the filing of a formal complaint on the rape and murder of a doctor at the state-run hospital.
The central probe agency’s inquiry procedure looks to be underway, according to the court’s order, which was dictated on September 25.
Denying Ghosh’s request for bail, Additional Chief Judicial Magistrate S. Dey noted that the charge is serious and that, should it be proven true, it might result in the death penalty, which is only used in very rare circumstances.
According to the judge, “releasing the accused on bail would be an injustice, flouting the principle of equity.”
He said in the order that one may commit an offense with the assistance of one or more people, and the other accused does not have to be present at the scene of the crime.
Furthermore, the court denied Abhijit Mondal’s request for bail.
It agreed to the CBI’s request for the two accused to be placed under judicial custody till September 30.
Before the court at Sealdah Court here, Ghosh’s attorney argued that his client was wrongfully accused of committing the crime and that he had not really done any of the associated acts.
On August 9, the postgraduate trainee’s corpse was discovered in the RG Kar hospital’s lecture hall, severely injured.
